1. Introduction

Welcome to MozaMarket. These Terms of Service ("Terms") govern your use of the MozaMarket platform, website, and services (collectively, the "Service") operated by MozaMarket Lda ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Definitions

  • Platform: The MozaMarket website and mobile applications
  • Buyer: A user who purchases products through the Platform
  • Supplier: A South African business that sells products through the Platform
  • Products: Goods listed for sale on the Platform
  • Order: A purchase request submitted by a Buyer

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. KYC Verification

For compliance with cross-border trade regulations, users may be required to complete Know Your Customer (KYC) verification. This may include providing:

  • Government-issued identification documents
  • Proof of address
  • Business registration documents (for Suppliers)

Failure to complete KYC verification may result in transaction limits or account restrictions.

5. Orders and Payments

5.1 Placing Orders

When you place an order, you are making an offer to purchase the Products. All orders are subject to acceptance and availability.

5.2 Pricing and Currency

Products are priced in South African Rand (ZAR) by Suppliers. Prices are displayed to Buyers in Mozambican Meticais (MZN) based on current exchange rates. The exchange rate is locked at the time of order confirmation.

5.3 Payment

Payment must be made in MZN through our accepted payment methods (M-Pesa, bank transfer). Orders are processed after payment confirmation.

6. Shipping and Delivery

MozaMarket facilitates cross-border shipping from South Africa to Mozambique. Delivery times are estimates and may vary. We are not responsible for delays caused by customs, weather, or other factors beyond our control.

7. Returns and Refunds

Please refer to our separate Refund Policy for information about returns, exchanges, and refunds.

8. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Submit false or misleading information
  • Attempt to gain unauthorized access to the Service
  • Interfere with the proper functioning of the Service

9. Intellectual Property

The Service and its original content, features, and functionality are owned by MozaMarket and are protected by international copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, MozaMarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mozambique, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting a notice on our website or sending an email.
